IJAW NATION ARISE!! CLAIM YOUR RIGHT: THE NEXT MANAGING DIRECTOR OF THE NDDC IS BAYELSA’S RIGHT TO PRODUCE.

While Ijaw Nation sleeps in the euphoria of one Nigeria, wicked elements at some power centre had brokered to misdirect the Presidency to elongate the tenure of the Office of the MD of NDDC presently occupied by Akwa-Ibom, to the undoing of the Ijaw Nation, wrestling away that which is Bayelsa’s legitimate claim (The MD of the NDDC).

ATTENTION: PRESIDENT MUHAMADU BUHARI, Vice President PROF. YEMI OSINBAJO, Sen. Bokola Saraki (Senate President), Yakubu Dogara (Speaker House of Reps), MR. BOSS MUSTAPHA (SGF), MUHAMMED MALAMI (AGF), Alhaji Abba Kyari (Chief of Staff to Mr. President) ALL SECURITY SERVICE CHEIFS AND THE INSPECTOR GENERAL OF POLICE:

While we are in no doubt on the power of the President to dissolve/extend the tenure of the board of the NDDC as provided by its establishing Act, we want to remind all concerned (especially the Presidency) that in line with the NDDC Act, the Letter of Appointment recently issued the present board as led by Mr. Nsima Ekere with effect from November 2016 and elapsing in November 2020, does not and cannot cover the Executive positions of the board. We recommend a careful perusal of Sections 3, 4 &12 of the enabling Act “the NIGER DELTA DEVELOPMENT COMMISSION (ESTABLISHMENT) ACT, 2000”.

Which provides thus as to tenure of the board: “Sec. 3(1) (Subject to the provisions of the Sec. 4 of this Act), a member of the Board, other than an ex-officio member, shall hold office for a term of 4years at the first instance and may be reappointed for a further term of 4years and no more”. Emphasis supplied.

Note that the above said section is subject to the provisions of Section 4 of the same Act. So let’s consider what Sec 4 provides, Sec.4 talks about rotation of office of the chairman in the following Alphabetic Order. Abia state Akwa-Ibom state Bayelsa state Cross River state Delta state Edo state, IMO state, Ondo state and Rivers state.

Buttressing further, the Act in Sec.12 (1) (d) which talks about the appointment of the Managing Director and Executive Directors; provides thus ” The MD shall hold office on such terms and conditions as to emolument, conditions of service as may be specified in his letter of appointment and subject to the provisions of Sec. 3 of this Act as provided above”

Cunning from the above; Sec.12(1)(d) which proviso is still expressly made subject to Sec.3 only goes to show that whatever appointment parameter and rotational order that is stipulated for the office of the Chairman of the Commission, also has same applicability to the office of the Managing Director of the Commission.

The point being stressed here is that Akwa Ibom state has served its tenure as MD given the fact that Mr. Nsima Ekere was only brought in to complete the 4years started by his predecessor Mr. Dan Abia who started out the Akwa Ibom tenure as MD. It is therefore the legitimate claim of Bayelsa state to produce the next MD of the commission, we call on all well-meaning Bayelsans to rise up to the occasion and demand what is rightfully ours.

We extend our call to all government structures including power brokers in the presidency to stand by justice and truth, as the bottom line remains that the appointment letter issued a fortnight ago to the board does not and cannot include Executive offices of the board, and President Muhammadu Buhari should not be seen to start a wrong precedent and ultimately dent Mr. President’s image as Mr. Integrity, as was almost the case in the issue of Mainagate (the former boss of the Pension Reform Board). Ijaw Nation and the IYC will not seat back and watch, any failure to address our demands will leave us no option that seek redress in the competent Court as soon as possible, while we also continue to explore our own means of sending our aggrieved message to the Nigerian state.

We wish to also inform the public that a wicked and ethnocentric plan has also been botched, a plan by the current MD Mr. Nsima Ekere to make the Akwa Ibom state rep to the NDDC to succeed him in the event of him resigning to pursue his governorship ambition in three months’ time, this plan is not only ethnocentric and wicked but is also unprogressive as it is capable of returning Niger Delta to its former state of disturbance and chaos, which everyone should jointly fight to prevent for the interest of the National economy.
